Minutes and a synopsis of the history of the theft of my property at Woodland Heights and Ballinacragga, Newmarket-on-Fergus, County Clare.

Minutes leading up to and attending the Court case at Ennis Circuit Court on Wednesday the 29th of November 2006 between Summerland Properties Ltd and John O'Doherty, Plaintiffs and John Gill, Defendant. Record number 01.2006.

Between 1 p.m. and 2 p.m. on the 28th of November 2006 I faxed my Affidavit to Solicitor John Hickie, Auctioneer John O'Doherty, both fax numbers of the Minister for Justice Michael McDowell T.D. and the Law Society of Ireland.

I then drove to the Ennis Garda Station and delivered a copy of what I know and believe was a false Sworn Affidavit and Notice of Motion which were served on me John Gill on the 22nd of November 2006 two hours after I received a phone call from a Solicitor who told me his name was O'Sullivan and a day before I was to appear in the High Court before the President of the High Court Judge Joseph Finnegan to be sent to prison for four months for something that everyone but everyone knew full well that I had nothing whatsoever to do with. But like thieves in the night, Solicitor John Hickie and Auctioneer John O'Doherty revelled in what they saw as a golden opportunity to steal my property, and steal it they would with the wholehearted support of some of the staff of the Ennis Circuit Court office together with the wholehearted support and connivance of the legal profession at the very highest level.

I also left with Ennis Garda Station's Chief Superintendent Mr John Keirns my replying affidavit and the documented evidence in exhibit form which proves without a shadow of a doubt that I John Gill am the legal, lawful and rightful owner of Folios CE11537F and CE6976F County Clare, which is the property that Solicitor John Hickie and Auctioneer John O'Doherty have been trying to steal for many years by just about every criminal act in the criminal code and with the total support of some individuals in the Ennis Circuit Court office and the legal profession. The properties are at Woodland Heights and Ballinacragga, Newmarket-on-Fergus, County Clare.

The misleading and false Notice of Motion was stamped on the 14/11/2006 at Limerick stamping office and lodged in the Circuit Court office in Ennis on the 17th of November 2006 if you can believe it, for hearing on the 29th of November 2006, just a week into my four month prison sentence. The false Sworn Affidavit was sworn on the 27th of October 2006, stamped 14/11/2006 and lodged on the 17th of November 2006.

For those of you who are suspicious or sceptical or wondering if I am a nutcase, please write or phone me and I will send you a copy of my sworn evidence to the court 29/11/2006.

On the morning of the 29th of November 2006 with my witnesses from Donegal, Limerick, Roscommon, Mayo and Dublin we took our seats in court number two and when the callover was complete, my case was called and Barrister Lorcan Connolly proceeded to read John Hickie's Motion and John O'Doherty's Affidavit. When I interrupted/objected I was assured by Judge Harvey Kenny that I would get my opportunity to defend myself, and I sat down.

I sat down but was unable to listen to Barrister Lorcan Connolly misleading the Court and perverting the course of justice, and right through the reading of the false Notice of Motion and false Sworn Affidavit of Hickie and O'Doherty I called each misleading paragraph for what it was (a lie) and I called the malicious wilful degrading insults of Barrister Lorcan Connolly a fraud (a fraud committed by Solicitors John Casey & Co of Bindon Street, Ennis, Co Clare). Fraud is being covered up by the whole of the legal and judicial establishment and this fraud is no different. How dare you Barrister Connolly tell the Court that I am an undeclared bankrupt when the criminal conduct of members of your profession like Solicitor John Hickie of 10 The Crescent, Limerick City, have committed perjury, forgery, distorted the facts, concealed vital evidence from the Courts, falsified documents produced while in the witness stand in the Circuit Court in Kilrush on the 29th day of April 2004 – a false and misleading letter from Clare County Council and other false documents - and you have the cheek to exhibit in your false Sworn Affidavit the Order of Judge Carroll Moran which was obtained by perjury, fraud and perversion of the course of justice. How dare you attempt to steal my property by fraud and deception!

You omitted to include in your false Affidavit my 100% Trust Document. You omitted to tell the Court or exhibit in your false Sworn Affidavit the fact that you lost on appeal before Supreme Court Judge Adrian Hardiman on the 15th of November 2004 when again John O'Doherty committed perjury while in the Witness

Box and was told by Judge Hardiman to stand down. Two days later in the High Court on Circuit in Limerick you were once more caught out. This well-planned cue (trickery), it never dawned on you that I would or could have an Affidavit ready sworn and lodged, this was the 17th day of November 2004 and the Right Honourable Judge Adrian Hardiman was the first judge in the history of this appalling miscarriage of justice to read and recognise the dates and the fraud committed by John Casey & Co. A serious unforgivable fraud exposed in documented evidence by Officer of the Courts G.N. Rubotham, and Solicitors Jim O'Donnell of Barrington Street in Limerick City.

You failed to include in your false documents that you tried to overturn the Order of Judge Adrian Hardiman on the 5th of December 2005 while nit-picking from the rules of the Superior Courts. When Judge Lavin preferred to let the case go to the High Court on the 15th of November from the High Court on Circuit you failed to tell the Court that you were before the High Court on four occasions after Supreme Court Judge Brian McCracken refused or would not hear the case on the 3rd of March 2005. The High Court hearings were on the 25th of April, the 9th of May, the 30th of May and the 27th of June 2005.

You did all this despite the fact that you knew right well that you John Hickie and John O'Doherty were being investigated by the Garda Bureau of Fraud Investigation and that I was granted my Motion by Judge Paul Gilligan on the 10th of October 2005 at which hearing John Hickie, you lied to the Court. This, Barrister Lorcan Connolly, you omitted from your sworn evidence to the Court on the 29th of November 2006, whether the Court Services can turn a blind eye to the false and misleading Order that was drawn up and sent out by certain members of the Circuit Court staff remains to be seen, an Order that was an insult and a blight on the character of Supreme Court Judge Brian McCracken. The case was heard on the 14th day of March 2006.

On the 14th of March 2006 Barrister Lorcan Connolly was refused costs when I confronted him and asked, costs for Lies and Perjury? Barrister Connolly then asked the Supreme Court Judge if it was all over and Mr Connolly was told loud and clear that it was. The Minutes of Attendance of the 14th of March 2006 was an Exhibit in my Sworn Affidavit before the Court on the 29th of November 2006.

I did tell the Court on two occasions that Solicitor John Hickie and O'Doherty are being investigated by the Garda Bureau of Fraud Investigation and on the off chance that they did not hear me I turned and looked straight into their eye.

When the Honourable Judge Harvey Kenny suggested that I get a Solicitor I told him that I had experienced fifty one solicitors and that just a few weeks ago the honourable Judge Michael Hanna told the High Court that he would not ask Mr Gill to get a solicitor as that would not be possible; how right he was.

In my Affidavit I displayed from Murdoch's Dictionary of Irish Law the law on Trust Property which is absolute, and which law has been seriously breached by Auctioneer John O'Doherty together with documented evidence of my fulfilment of my obligation in the purchase of this Trust Property in good faith, and in time. I also made it very clear to the Court that I purchased and paid for the property in good faith.

On the morning of the 30th of November 2006 there were two messages left on my answering machine that I did not receive until late afternoon, they came from a retired Garda and a UCC graduate, friends of mine. Those two people knew the story and character of John Gill and were stunned.

The message was that there was an article on the fourth page of the Irish Times of Thursday the 30th November 2006 that was detrimental to my good name and character. It was as if it was a deliberate and wilful attempt at character assassination and a most rotten disgusting piece of gutter journalism. It was meant to show me up in the worst possible light. I faxed my complaint to the editor and spoke to a Rita Hughes at the Editor's department at 10.35 a.m. who admitted it was wrong and said that it would be investigated by a Paul Gillespie. I later spoke to Emma Allen, assistant at the Editor's office at 4.20 p.m. After my interview I was told that my conversation was recorded. I said ok.

I have drafted the article onto a four page and will demand an apology of similar size on page four of the Irish Times newspaper. Within an hour of me speaking to the Irish Times people I had a call from Susan Dermody of the Ennis Circuit Court to say that the County Registrar was at a meeting in Cork and that she would have him send out the Order/Judgement of Judge Harvey Kenny on Monday morning next.

I must also put on record that I am viciously threatened by John O'Doherty and if anything happens to me I want the blame thrown squarely at the feet of the legal and judicial professions. Solicitor John Hickie is not only the legal advisor of Auctioneer John O'Doherty but I was reliably informed by an Officer of the Courts that he was part and parcel of the theft of my property.
