AFFIDAVIT OF JOHN GILL

I, John Gill of Drumline, Newmarket-on-Fergus, County Clare, aged eighteen years and upwards make Oath and say as follows:

I am the Defendant in this matter, I make this Affidavit from the facts within my own knowledge save where otherwise appearing and where so appearing I believe same to be true.

  1. I say and believe that this is a malicious and wilful attempt to STEAL my property by two OPPORTUNISTS who sought to take advantage when they read articles in the Irish Independent and Irish Times newspapers dated the 21st of November 2006 which read that I John Gill was being jailed for four months (JAILED FOR 4 MONTHS FOR SOMETHING I DID NOT DO AND HAD NO KNOWLEDGE OF). On Wednesday the 22nd of November I received a phone call from a gentleman who said he was a Solicitor named O'Sullivan. He asked are you going to take this material from the website. I said I have no way of doing so and that I am busy preparing an Affidavit and a Habeas Corpus document to hand around to the media and my supporters for wrongful imprisonment for the Director of Public Prosecutions and the Governor of whatever prison I may be in. Before I realised, the said Solicitor had disappeared and I was left talking to myself. In less than two HOURS, there was a knock on my door and I was served with a Notice of Motion and Affidavit from John O'Doherty and John Hickie. I beg to refer to the Irish Independent and Irish Times articles dated the 21st of November 2006, Exhibit J.G. 1 & 2. I have signed my name prior to the swearing hereof.

  2. I say and believe that both Notice of Motion and Affidavit signed by John Hickie and John O'Doherty are malicious, false and misleading documents. The Order exhibited from the Circuit Court in Kilrush was obtained on false and misleading sworn evidence. I beg to refer the false and misleading evidence to the Court. ORDER dated 29th of April 2004. I beg to refer to my Affidavit sworn on the 14th of March 2006, 46 pages inclusive. I have signed my name prior to the swearing hereof.
  3. I say and believe that the Order of the Honourable Supreme Court Judge Brian McCracken exhibited in the Affidavit of John O'Doherty is NOT the Order of Judge McCracken of the 14th of March 2006. I beg to refer to Minutes of Attendance at the High Court on Circuit on the 14th of March 2006. Exhibit J.G. 4. I have signed my name prior to the swearing hereof.
  4. I say and believe that the Law on TRUST property is absolute, which I exhibit from Murdoch's Dictionary of Irish Law pages 815-818 (Breach of Trust) and Fraudulent Conversion on page 345. I beg to refer to Exhibits J.G. 4 to 9. I have signed my name prior to the swearing hereof.
  5. I say and believe that I objected to the false prepared Order of the Registrar of Ennis Circuit Court Office on its own pages. I beg to refer to the said Orders/Objections and to the Order of Supreme Court Judge Adrian Hardiman of the 15th of November 2005. Exhibits J.G. 10 to 13. I have signed my name prior to the swearing hereof.
  6. I say and believe that this attempt to STEAL my Trust Property from Folio CE11537F County Clare and my building site at Woodland Heights, Newmarket-on-Fergus, Co. Clare is a new LOW. This is like thieves and robbers taking advantage of when families go on holidays or when old people go out to do shopping or to watch football. Site #3 is at Woodland Heights, Newmarket-on-Fergus, Co. Clare and it is the access route to the land-locked Folio CE11537F.
  7. In conclusion, I would like to thank the President of the High Court Judge Joseph Finnegan who saw through what I was wrongfully subjected to over a period of nine appearances in the High Court, and my supporters from 28 counties of Ireland who have been and are subjected to the same corruption and abuse that is waged against me John Gill by Solicitor John Hickie and Auctioneer John O'Doherty. I pray that this Court will dismiss and strike out the Motion of John O'Doherty and John Hickie with damages and expenses against them, and if this is not possible I will be seeking a JURY TRIAL. This case has gone on for far too long and must be brought to a speedy conclusion.
