I had before the court a Notice of Motion: To vacate and rescind the adjournment order of Justice Eamon DeValera of the 27th June to the 10th October 2005 because of the fact that my file of this whole matter was referred to the Garda Bureau of Fraud Investigation (Case Record No. 2005/125.CA) with leave to re-enter the case if the circumstances arise.

In court representing the defendant John O’Doherty, Auctioneer was Solicitor John Hickie of 10 the Crescent, Limerick City.

My case was first on the call over list. When I was called by the Honourable Justice I walked up to the bench and read out my Motion to the Court. Solicitor for John O’Doherty, John Hickie told the court that he was not served with a copy of the Motion (as an officer of the court Mr. Hickie LIED to the court. The Motion, Affidavit and Exhibits were sent by registered mail from Dublin to John Hickie, Solicitor, on the morning of the 30th of September 2005. An Post were unsuccessful in delivering the Motion, Affidavit and Exhibits on Monday the 3rd October as there was no answer at the office of John Hickie but were successfully delivered on the 4th October 2005.

John Hickie, Solicitor, then asked the court if the second adjournment would go ahead. I told the Honourable court that there was no other adjournment and Solicitor John Hickie was forced to agree. The Honourable Justice Paul Gilligan granted me an adjournment with liberty to re-enter the case if the circumstances arise. Mr. John Hickie then asked the court that the case not be entered before the end of this year. The Honourable Paul Gilligan told Mr. Hickie that if Mr. Gill decides to re-enter the case he will serve you with a copy and you, Mr. Hickie, can do likewise if you decide to enter the case.

I must reiterate that John O’Doherty and his legal team have repeatedly lied and committed perjury before the courts.

On the 9th May 2005 Counsel for John O’Doherty told the court and denied that I had served documentation on them. When in actual fact they were served with the documentation on the 15th of November 2004 and a further copy a week previously.

On the 29th April 2004 John O’Doherty while in the witness stand did produce to the court a false document dated the 28th April 2004 which was sought from Clare County Council engineer Walter Walsh. This was a malicious and deliberate attempt to mislead the court and must be investigated and punished if justice is to be done and seen to be done. This is only a synopsis of what an Honourable Justice has to cope with in the courts every day.
