Upon Motion of the Defendant in person made unto the Court this day pursuant to Notice of Motion herein dated the 21st day of December 2007 for an Order for a Mareva Injunction on the grounds that the Order dated 18th day of December 2008 made against the Defendant on the application of the Plaintiffs in the title hereof is an infringement on his constitutional rights under Article 40.3.1 and Article 40.3.2 of the Constitution and Article 40.6.1.(i) including Article 40.(ii) & (iii)

Whereupon and on reading said Notice of Motion the Affidavit of Allan Lewis filed on the 13th day of December 2007, the Affidavits of John Gill filed on the 24th day of January 2008, the 11th day of February 2008 and the 3rd day of March 2008 and the documents and exhibits respectively referred to therein and upon hearing the Defendant in person and Counsel for the Plaintiffs

IT IS ORDERED that the said Motion be refused

And IT IS ORDERED that the Defendant do pay to the first Named Plaintiff their costs of this Motion when taxed and ascertained.
