VICTIM AT GREEN STREET CRIMINAL COURT

MINUTES OF ATTENDANCE AT GREEN STREET CRIMINAL COURT OF JOHN GILL AND FOURTEEN VICTIM SUPPORTERS ON THE 3RD OF MARCH 2008. REF: THE GOVERNOR & COMPANY OF THE BANK OF IRELAND & ALLAN LEWIS (PLAINTIFFS) AND JOHN GILL (DEFENDANT)

We arrived at the Four Courts at 9.25am on the 3rd of March 2008. I went to the stamping office and had my third Supplementary Affidavit stamped with a E15.00 stamp while my witnesses went to the reception desk at the round room in the High Court. From the stamping office I went to the photocopying office and made three copies of the stamped document for the presiding Judge and the Bank of Ireland legal team.

On Thursday the 28th of February I received a slot to have my case against Allan Lewis (Legal Advisor to the Bank of Ireland) heard at the Distillery Building before Judge Birmingham on the 3rd of March 2008, but because of the treatment of ordinary people by the Legal Profession in their determination to obstruct and/or deny us access to the Courts and Justice in the most foul and calculated manner imaginable, I decided to do a double check and search to be absolutely sure.

At approximately 9.55am I called to the listing office and was shown a list to read for myself where my case was being heard at the Kings Inns, not my case but that Judge Birmingham was sitting at the Kings Inns. I said, "no this is not true". The Court Official then excused himself, asked me to hold on and left the office. When he returned I was told that my case was being heard at the Green Street Criminal Court before Judge George Birmingham, and the honourable official told me that Registrar Kevin O'Neill was about to lift the phone when he walked in the door "to phone me in County Clare to alert me of the change of venue". I say that Mr Kevin O'Neill was about to phone County Clare because my home phone number (061-360436) was the only phone number in his possession. It was now after 10am and with so many supporters going direct to the Distillery Building and with no means of making contact with them we were in a delicate situation. On my return to the reception of the High Court near the round room we decided that twelve was a good number of witnesses and that we would start the ten or fifteen minute walk to the Green Street Criminal Court.

On our arrival in the Courtroom all of us sat on the high seats at the rear of the Courtroom. When my case was called the only people remaining in the

Courtroom were the Honourable Judge George Birmingham, the Judge's minder, Registrar Kevin Bresnan, the Bank or Ireland's legal team, Barrister Paul McGarry, Solicitor Liam Lavelle, another gentleman who may or may not be an Official of the Bank of Ireland, and my fourteen witnesses.

For all intents and purposes this would have been an in camera rules case, a behind closed doors Kangaroo Court hearing if it were not for the fourteen witnesses from Mayo, Roscommon, Donegal, Dublin, Clare, Laois, Offaly and Tyrone. Nevertheless it was very peaceful, comfortable, different in many ways and presided over by a very patient Judge who was willing to listen.

When my case was called I was called to come up close to the Bench, and for the first time in my 76 appearances in Court I was one seat closer to the Honourable Judge than the opposition. I had the whole fifteen feet long bench to lay out my many files of sworn evidence.

I began by telling the Court that the Affidavit of Allan Lewis which was served on me on the 14th of December 2007 at 9.15am was an absolute Fraud (the Affidavit of lies that I held up before the Court is undisputed Perjury). I then held up to the Court a copy of the Bankruptcy Act 1988 and told the Court that Solicitor Allan Lewis had no legal right to be in this case.

I told the Court that the Bank of Ireland held Security to the value of £300,000.00 for a loan of £22,041.82 and that not alone was this fact omitted from the false Sworn Affidavit of the Bank of Ireland and Allan Lewis, their Legal Advisor, but their Barrister Mr Paul McGarry misled the Court before Judge Sheehan on the 18th of December 2007 when he maliciously omitted and/or skipped paragraph no 7 of my sworn evidence while reading and taking it on himself to read my Affidavit to the Court.

The only argument or excuse that the Bank of Ireland's team were able to rely on was more lies and fraud to cover up for six-and-a-half years of Mass Corruption, Criminal Deception and Mass Perjury instigated and perpetrated by their Legal Advisor Mr Allan Lewis and supported by Barrister Paul McGarry and Solicitor Liam Lavelle, who were in Court trying to rescue Allan Lewis. Using fraud to suppress fraud - not possible you might say, but like Billy the Kid they don't surrender until they are taken down.

Despite all of the evidence and facts, Mr Paul McGarry B.L. did try to revisit and/or rehash a dead duck: the corrupt Bankruptcy. Mr Paul McGarry tried again to mislead the Court by telling the Court that my new evidence to the Supreme Court was refused. Before Mr McGarry had time to blink I turned and told him straight to his face that this was untrue (before moving on, it is true that in his false Sworn Affidavit Mr Allan Lewis did Exhibit a two page false corrupt Order purporting to come from the case in the Supreme Court as a True Copy). I then produced a copy file which I had prepared and sent to the previous Minister for Justice Mr Michael McDowell and handed it to Judge Birmingham who gracefully accepted it. This document exhibited the Truth, a ten page Order which was handed to me ten minutes before my case commenced in the Supreme Court, and the two page Order which was exhibited in the false Affidavit of Allan Lewis, together with details of the fracas and/or frenzy that erupted when I was three fifths of the way through my Hearing in the Supreme Court. The reason for this fracas was that I explained to the Court that I had won three fifths of my case, and the Solicitors and Barristers were not going to allow the truth to be heard and/or I was not going to be allowed to win. This was the kind of corruption and denial of justice that gave birth to CrookedLawyers.com and Rate-Your-Solicitor.com

I did tell the Court that it was Neil Fennelly who signed the Order that was handed to me ten minutes before my case commenced and which evidence I gave to Judge Birmingham. I also told the Court that the only one of the three Judges who made any attempt to try to stand up to and/or try to quell the bully-boy tactics from the floor of the Court was Judge Susan Denham. All of this evidence came about as a result of Judge Birmingham telling me that he could not overturn the Order of another High Court Judge. I also tried to explain that the Minister for Defence Willie O'Dea told me that it was another Supreme Court Judge who appointed Thomas Tynan and Bill Holohan who were involved in the robbery with Allan Lewis of the Bank of Ireland, but Judge Birmingham was not interested in who appointed who and the case moved on. For many people Judge Birmingham's advice to appeal to the Supreme Court may be a solution, but for me it was like jumping out of the frying pan and into the fire.

In my evidence to the Court, I also produced to the Court and Judge Birmingham a copy file of my third Affidavit which caused Judge Michael Hanna to dismiss himself from hearing my case in September 2006. In this Affidavit, which Judge George Birmingham preferred not to see or read, were names that I read to the Court. They were the fugitive offender and property and money grabbing thief Michael Lynn, who I told the Court was my neighbour from Crossmolina, Co. Mayo and who in September 2006 phoned and threatened me with fire and brimstone. I named Barrister Brian McInerney, whose false Sworn Affidavit is in my third Affidavit before Judge Hanna. The named Solicitors are Shaun Elder, Bill Holohan, Andrew Darcy, Joe Griffin, Judge Sean O'Leary (now deceased) and John Casey & Co, Ennis, Co. Clare. I named all as far as possible that I could remember that were part of the criminal ring with the Legal Advisor to the Bank of Ireland, Solicitor Allan Lewis.

I told the Court and Judge Birmingham what a barrister said in Court in Wexford, that Justice should be done and seen to be done in the Courtroom and not out on the streets or on websites. I told Judge Birmingham that almost all of the criminal conduct of Solicitor Allan Lewis, the Sean O'Leary story and others were on the website. Before the Court started, the Bank of Ireland team was overheard saying that the Court was the place for John Gill. I reminded Judge Birmingham that we had exposed and dealt with the shocking conduct of the clergy and the corrupt politicians in the Tribunals, and now we were down to corruption in the legal profession, which most people believe is more corrupt than all of the rest put together. While all of this was going on, Barrister Paul McGarry, who not alone had his name on false Sworn documents but had on this occasion and on the 18th of December 2007 misled and/or attempted to mislead the Court had he not been prevented from doing so by my good self.

Judge George Birmingham was willing to listen but was he about to judge without fear, favour, affection or ill will towards any man, we could only hope. I even turned around and introduced the fourteen supporters as a group suffering the same fate as myself at the hands of a corrupt legal mob.

All of my evidence to the Court was 100% true and could not be touched or disputed by Barrister Paul McGarry or by Solicitor Liam Lavelle and the Bank Official beside him, who my supporters told me were taking notes and writing down everything that I said. I told the Court about my knowledge of Real Estate Law from Canada and about the corrupt criminal conduct of John Casey and Company from Ennis, Co. Clare in the attempted theft of my bungalow which I built jointly with a lecturer from the University of Limerick, and which was and is a carbon copy of the criminal deception that Solicitor Allan Lewis is involved in today.

I handed to the Court a copy of my third Supplementary Affidavit and explained to the Court that I discovered that the Land Registry Office at Nassau Street, Dublin who are involved with and colluding with those who will never defeat me with criminal thuggery. I told the Court that I was not in Court to sue anyone, all I was demanding was the return of my money (E17,041.82) which was stolen from me, and my two Original Land Certificates which are held by the Bank of Ireland and Allan Lewis on false documentation, perjury and corruption on a massive scale.

I mentioned that people from Spain who were in Court with me on the 11th of February 2008 were victims of the Bank of Ireland and they will hear all about them in the very near future. I also told the Court of victims from Philadelphia and New York, one of whom is a victim of the Bank of Ireland but did not mention the name of the solicitor. I also told the Court of the sad passing of five of our victim members who passed away in the last year and a half without getting justice and that grabbers and crooks keep all - a damning indictment of a Legal and Judicial System that has total contempt for the Law and the Constitution.

I reminded the Court that this was my 76th time before the Courts with 25 judges and 55 barristers and solicitors, and that the penalty for Solicitor Allan Lewis and his criminal conduct was a fine or ten years in prison or both. I also said that I believed that Judge Sheehan, who went into his chambers for half an hour or more to read my Affidavit, was when he returned not angry with me but with the appalling evidence of corruption which evidence had forced Judge Hanna to dismiss himself from hearing any more of my case.

When Judge Birmingham finally got tired listening to the volume of corruption and no doubt observing the subdued demeanour of the Bank of Ireland trio, I was asked what relief I expected from the Court. I said loud and clear, the return of the E17,041.82 stolen from me and the return of my two Original Land Certificates complete as the Bank of Ireland received them, and as happened with twenty one of the previous judges, Mr Justice George Birmingham sided with the corrupt fraudsters of the Bank of Ireland, which I told the Court leaves us with no option but to go to the streets and expose them for what they are. This is no different to the way Judge John O'Hagan treated the Gallaghers and John McMahon in Donegal and Cavan or the way Judge O'Neill treated John McMahon in the High Court, accepted the lies of Barrister Nolan before the truth of a number of witnesses, or the conduct of Judge deValera on four occasions in my case and the appalling treatment of our deceased victim Ger Cullinan in Clonmel by deValera who on Wednesday said the Cullinans purchased and paid for the property in good faith. DeValera did the dirt for one reason or another, many senior civil servants will say that he (deValera) was got at overnight because on Thursday morning he had changed his mind and was like a bag of weasels and ruled against Ger Cullinan.

There are many calls and questions being asked about Judge George Birmingham. This morning the 5th of March 2008 at 9.28am I have received a phone call from husband and wife supporters and victims to say that Judge George Birmingham beckoned his minder who was standing some fifteen feet away and asked him to call the Gardai as my case was being heard. I asked how he knew and he told me that he heard quite clearly, and the Gardai arrived within minutes. What kind of a rotten twisted country do we live in? It is now 9.51am and a caller from Cork has informed me that Judge George Birmingham was a Junior Minister in John Bruton's Government.

Until recent times the lay litigant was bullied and roared at from the bench and was given 5% or less of the time to defend himself as I myself witnessed in the case of Judge John O'Hagan in Letterkenny with Elva Gallagher and John McMahon, on four occasions in the High Court before Judge Eamon deValera, in Clonmel before Eamon deValera with the deceased Ger Cullinan and in the High Court before Judge Joseph Finnegan when Judge Finnegan promised me four months in prison in a conspiracy case to silence me and deny me my Constitutional Rights and my rights under the European Charter on Human Rights. Judge Finnegan also promised that he would make an Order to seize the assets of all of the Victims of the Legal Profession and make us all poorer. Judge Finnegan was then the President of the High Court and was a few days later promoted to the Supreme Court.

On Monday the 23rd of July 2007, I with a group of witnesses in the High Court watched the appalling abuse of a retired Garda by the current President of the High Court Judge Richard Johnson, and we have now been told that the Judiciary have in the recent past changed their tactics from bully-boy tactics and screaming at lay litigants to giving them all the time in the world to say what they want to say but in the end rule against them and find in favour of the criminal corruption, perjury and deceit of the Legal Profession who have robbed and destroyed them by flouting the Law and ignoring the European Convention on Human Rights. Bring back Michael McDowell and before it is too late, bring in the watchdog to monitor and deal with crooked Judges.

I will never get finished. The Donegal witnesses believe that Judge Birmingham called the Gardai to intimidate not me John Gill, but my witnesses who were there to witness and report the happenings in this isolated Criminal Court.

To quote from number three of my third Supplementary Affidavit: "Illegal contracts which are forbidden by statute are contrary to Common Law and are contrary to the Constitution and thereby contrary to the European Convention on Human Rights; such contracts are void and collateral contracts are also vitiated (not worth the paper that they are written on)". This must also apply to malicious false prepared Court Orders that favour lies, deception, perjury and generally rotten, corrupt, unlawful behaviour from wherever it raises its ugly head.
