EIGHTH AFFIDAVIT OF JOHN GILL

I, John Gill of Drumline, Newmarket-on-Fergus, County Clare, aged eighteen years and upwards make Oath and say as follows:

  1. I am the Defendant in this matter, I make this Affidavit from the facts within my own knowledge save where otherwise appearing and where so appearing I believe same to be true.
  2. I say and believe that this action taken against me from the 6th of September to the 20th of November 2006 was and is a vengeful resentment-inspired campaign of threats, harassment and intimidation using lies, deception, false sworn evidence and concealment of vital evidence from the Courts. This action taken by McCann Fitzgerald Solicitors for the Plaintiff Jayne Maguire has no meaning in Law or Justice, and for justice to be done and seen to be done, this action must be rejected, dismissed and struck out with damages and expenses awarded against the Plaintiff and by McCann Fitzgerald Solicitors.
  3. I say and believe that the article in the Irish Independent of the 6th of September 2006 by Dearbhail McDonald, Legal Affairs Correspondent, is false and misleading – see Affidavit sworn by John Gill, 8 September 2006. EXHIBIT J.G. 1.
  4. I say and believe that the Affidavit of Jayne Maguire, sworn on the 7th of September 2006 is false, misleading, a farce and a joke and riddled with inconsistencies in a malicious attempt to pervert the course of justice. I beg to refer to copy of Jayne Maguire's Affidavit sworn on the 7th of September 2006 and EXHIBITED in my Affidavit sworn on the 8th of September 2006.
  5. I say and believe that the invitation to go on Cork 96FM was not a coincidence. It was a well-planned CUE to have a trial before a trial by the Plaintiff Jayne Maguire, McCann Fitzgerald Solicitors, with Dearbhail McDonald and Presenter Mr Neil Prendeville and his back-up team acting as judge and jury. I beg to refer to the 47-page Sworn Affidavit and Exhibits served on me on the 13th of September 2006 by Barrister Karyn Harty. I do not believe that what they said went out over the airwaves ever went out, as I did not know or ever hear the name Jayne Maguire or her colleague who I was told posted the obscenity on the website, so therefore I could not have said anything about Jayne Maguire as she admits in her Sworn Affidavit of the 7th of September 2006.
  6. I say and believe that the Plaintiff Jayne Maguire and her legal team McCann Fitzgerald Solicitors may believe that they are invincible but the world and his wife from the four corners of the Earth know at this stage that their invincibility if maintained will be by successfully perverting the course of justice, by twisting and changing the rules to suit themselves on each and every one of the Court appearances (eight in all) from the 11th of September 2006 to the 20th of November 2006.
  7. I say and believe that the behaviour of the Plaintiff Jayne Maguire and McCann Fitzgerald Solicitors is intransigent as they know perfectly well that they are on the ropes, but will not surrender. They will not surrender because they know full well that some way somehow they will turn this misleading and false action in their favour and hopefully get a conviction on their terms, their terms being lies, deception, perverting the course of justice, concealing vital evidence from the Courts and changing the rules at will and without hindrance.
  8. I say and believe that what I am subjected to is typical and widespread throughout Ireland today, it is a raging cancer that has driven many Irish people to suicide, to taking others' lives. It has destroyed thousands of Irish families. It has driven many hundreds if not thousands of good people out of Ireland. Business people and those from all walks of life suffer from severe health problems because of worry and stress inflicted by a greedy grabbing lot who have total contempt for the laws of God and Man and lack moral values.
  9. I say and believe that whatever Judge presides over the final ending of this case will do so with honour and truth without fear or favour. The evidence is overwhelming and I beg that the case be struck out with damages and expenses.
