HISTORY AND ATTENDANCE AT THE HIGH COURT IN THE MATTER OF JOHN McMAHON OF COOLSKEAGH, CASTLEBLAYNEY, CO. MONAGHAN ON MONDAY THE 24TH OF JULY 2006 AND WEDNESDAY THE 26TH OF JULY 2006 AND AT CAVAN CIRCUIT COURT ON THE 27TH OF JULY 2006, AND THE APPALLING STORY OF THE INTERVENING PERIOD.

I attended with witnesses from five Counties at Court 21, The High Court on Monday the 24th of July before Judge Murphy with an application for Judicial Review (an Order seeking Habeas Corpus) in respect of John McMahon, and a grounding Affidavit.

At approximately 4.30 p.m. the Honourable Judge Murphy asked if there was any more business. I then stood up and walked up to Registrar David Neenan to whom I had earlier given my documents in relation to John McMahon. I was interviewed and questioned by the Honourable Judge about what I knew about John McMahon. I told Judge Murphy of the history of the late Peter Shevlin and John McMahon and that I knew the offices of Corrigan, Coyle, Kennedy, McCormack and McGrath Solicitors in Castleblayney. I told of the visit by John McMahon to where Peter Shevlin was killed on the morning after Peter's death. I explained to Judge Murphy how the lights were on in Mr McGrath's office in the early hours of that morning and that John McMahon had also observed that the lights were also on in the attic dormer windows where Corrigan, Coyle, Kennedy, McCormack and McGrath kept people's Wills. John McMahon believed that Mr McGrath was up in the attic looking for Peter Shevlin's Will for the funeral arrangements. John McMahon decided not to call into the office and instead went back to Peter Shevlin's house to await a call that never came.

I told Judge Murphy that John McMahon called to a Journalist in Dublin to ask if she would come into Court and report on the conduct of his Solicitor, the opposition Solicitors and the Barrister for the opposition. It was this Journalist that told John McMahon to make contact with me, John Gill. I told Judge Murphy that I knew John McMahon's wife and family, that I had visited Castleblayney and that John McMahon had visited me in Co. Clare. Judge Murphy told the Court after he had read my documents and interviewed me that the Courts took this matter very seriously, and Ordered that John McMahon be brought before his Court on Wednesday the 26th July 2006. Judge Murphy asked if I could have documents served on the Director of Public Prosecutions and on the Governor of Castlerea Prison. I told the Judge that yes I should be in a position to carry out this duty. I asked Registrar David Neenan when he would have the Order of Judge Murphy ready and was told to collect same in the morning at the Central Office of the High Court.

I took the train back to County Clare and arranged to have the Order of Judge Murphy collected by Vincent and Teresa Toolan of Prime Time fame. Vincent phoned me at 10.38 a.m. on the morning of the 25th July 2006 to say that they were having some difficulty in getting a copy of Judge Murphy's Order. At 10.42 p.m. I finally convinced a gentleman from Central Office to release the Order.

Vincent and Teresa then faxed me a copy from Reads and a copy to Donal in Castlerea, Co. Roscommon close to Castlerea Prison. In turn I faxed the Application and Sworn Affidavit as was presented to Judge Murphy, to Vincent and Teresa and to Donal in Castlerea. Donal served the Documents on Assistant Chief Officer Casey in Castlerea Prison and Vincent and Teresa served the Documents on the Director of Public Prosecutions and got a receipt.

It was I, John Gill, who phoned Castlerea Prison at 9.25 a.m. on the morning of the 25th of July 2006 and spoke to Assistant Chief Officer Casey when I failed to talk to the Governor, whose name I was told was Dan Scannell. When I told the story to Mr Casey, he told me that this was normal procedure.

I phoned Castlerea Prison again at 5.35 p.m. The lady that I spoke to told me how difficult it was to get in contact with John McMahon and said that she would phone me back. The call did not come and I phoned again at 5.55 p.m. This lady was not very friendly and gave her name as Officer Murphy. She told me that John McMahon was in line to speak to me and had until 7.20 p.m. to speak to me. I did get to speak to John McMahon before 7.20 p.m. I also faxed the Order of Judge Murphy to Ann McMahon, wife of John McMahon.

The last line of Judge Murphy's Order states and I quote, LIBERTY TO NOTIFY THE RESPONDENTS OF THE MAKING OF THIS ORDER BY TELEPHONE AND FAX.

On the morning of the 26th July 2006 I arrived at the reception desk of the High Court in the company of Ann McMahon, her son Sean McMahon and Donal Rogers who served the documents on Officer Casey at Castlerea Prison. We were told that Judge Murphy was sitting at Bow Street Court at 11 a.m. In the mean time Vincent and others were sitting outside Court 21, Aras Ui Dhalaigh.

When we arrived at Bow Street Courthouse we were told that the Honourable Judge Murphy was sitting upstairs and were shown where the Courtroom was and the toilets and so on. We had some friendly exchanges with Judge Murphy's minder who recognised me as being John McMahon's friend from two days ago and the previous week. When there was no John McMahon arriving and no Judge Murphy at 11 a.m. we began to get suspicious. There was no sign of Judge Murphy, yet his minder was there and so was David Neenan the Registrar. We were now told that the Court was now sitting at 11.15 a.m. With our suspicion growing we checked at the entrance desk and were told that Judge Murphy was sitting at Court 21, Aras Ui Dhalaigh. This as it transpired was a malicious and deliberate LIE by the gentleman at the desk.

We immediately rushed over to Court No. 21 and went inside to find that the Court was in session and the Judge on the bench was not Judge Murphy. We then decided to run as fast as possible over to Bow Street, went upstairs and found Judge Murphy on the bench with a Barrister on his feet. We occupied the back line of seats and within seconds the Barrister looked back, and whatever was going on was brought to an abrupt end to allow us to say what we had to say. I was called and explained that the documents were served on Castlerea's Assistant Chief Officer Casey and on the Director of Public Prosecutions by Vincent and Teresa Toolan and Donal Rogers who served the documents in Castlerea Prison. There was an attempt to nit-pick and find a loophole in the serving of the documents in Castlerea Prison and when that failed, Judge Murphy asked the Registrar to make contact with Castlerea Prison and asked us to return at 2 p.m.

After deliberation we decided to phone Castlerea Prison. I made a call at 11.55 a.m. and asked why John McMahon was not in the High Court, the gentleman that I spoke to said that the Papers were served on the Prison for John McMahon yesterday and I was then handed over to a gentleman called Tony Kilbane who was most rude and disputed the fact that the documents were served. I handed the mobile phone to Donal Rogers who served the documents at the Prison. Mr Kilbane said to Donal, "you served the documents here yesterday." Mr Kilbane said we have to have the Order from the Registrar; Donal told him that the Court Registrar will be making contact with you.

Back in Bow Street at 2 p.m. We were put through the whole rigmarole again including the contact with Castlerea Prison and Mr Tony Kilbane that was in our evidence. I was accused of not telling the Court that John McMahon was in Cavan District Court on Friday the 27th of July 2006 and other trivial nonsense to divert from the real issue (cover-up). Judge Murphy's final excuse was to wait for the outcome of the appearance of John McMahon at Cavan Circuit Court on the 27th of July 2006.

A huge disappointment for John McMahon's wife and son and for all of the witnesses and supporters. I got the train back to Co. Clare; on my way back I telephoned other supporters to prepare a file for the Cavan Circuit Court Office. I collected my car at Limerick Railway Station and set out for Cavan Town. While I was stopped in traffic on the main street in Granard, Co. Longford I spotted the picture of Michael Collins on the outside wall of a Hotel and in the words of the late Peter Shevlin often spoken to John McMahon "that's my man." I stayed in the Hotel. Our mission I felt was very similar - the destruction of tyranny and unfinished business.

The file that I handed to the Registrar in Cavan Circuit Court before the Honourable Judge John O'Hagan, I felt should be a test for any right thinking man on the bench with an ounce of humanity in his fingertips. When the tight handcuffs were removed from John McMahon's hands I walked up and asked him to ask the Honourable Judge to first read the Affidavit that was handed to the Registrar. The Honourable Judge did read carefully this Affidavit and without delay did a most unusual turn, ordered the release of John McMahon after seventeen days behind bars. The abuse that John McMahon has suffered by certain people while in custody will be later told by John McMahon himself.

While in the Central Office of the High Court in Dublin on Friday the 28th July 2006 and while Lodging a Notice of Motion, John McMahon was sneered at and prevented from lodging his Motion to apply for an Injunction to stop the perpetrators and instigators of this multi-million Euro fraud until there is an investigation into the whole matter by the Criminal Assets investigating team.

This is not only the work of the Criminal Element of the Legal Profession but has also the full support of a Criminal Element in Kildare Street's Dáil Eireann and much more will be exposed in the coming months.

John McMahon may be a free man who has suffered greatly at the hands of thugs, but this and other stories are far from over. It is a fact that the Legal Profession is responsible for the harassment and difficulty that Lay Litigants are subjected to in the so-called Court Offices all over Ireland. Interference is massive as our experiences can prove and there is no use in complaining to our elected representatives as we have discovered to our cost that many of them are part and parcel of this thuggery.

The very gentleman that tripped up John McMahon on Friday the 28th of July 2006 pulled a similar stunt on the 17th of July 2006. On the 17th July he referred me to the reception desk at the Round Hall to enquire and find out where the Common Law Court was sitting and to go before whatever Judge was sitting Ex Parte, to present my Habeas Corpus Application to have John McMahon released from unlawful custody. On that occasion I was told that it was sitting in Bow Street before Judge Peart. When I with a witness arrived at Bow Street Court Reception I was prevented from getting into Court by the same gentleman who lied to us on the 26th of July 2006 (we have no names but will if need be, identify them) and to add insult to injury whether this gentleman was aware or not, we were referred to Judge O'Neill in Court 9, the very Judge who accepted lies from Barrister Peter Nolan in Court 13 on the 26th of June 2006 even though ten witnesses came forward, Judge O'Neill accepted the lies which resulted in John McMahon being locked up unlawfully for seventeen days.

After some discussion and reflection it was agreed that we had a better chance of going before Nelson's Pillar to plead for Justice, which is a true and sad reflection of what the major parties Fianna Fáil and Fine Gael have and are turning a blind eye to and have done so since the foundation of the State.

Minister for Justice Equality and Law Reform Michael McDowell T.D., the work of the watchdog you promised some years ago was never more needed. You must know that at least some of those political appointees were corrupt and you were correct, corrupt as you will find out very soon is an understatement!
